Welcome to Eternup. By accessing or using our website, mobile application, or services (collectively, the 'Platform'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and Eternup Biotech Private Limited ('Eternup,' 'we,' 'us,' or 'our').

2. Service Description

Eternup provides AI-powered personalized skincare analysis and consultation services, including but not limited to:

• Facial image analysis using artificial intelligence technology
• AI-driven dermatology consultation via voice interface
• Personalized skincare recommendations and reports
• Lifestyle and environmental factor assessment
• Product recommendations based on individual skin profiles

IMPORTANT: Eternup is NOT a substitute for professional medical advice, diagnosis, or treatment. Our AI analysis is for informational and educational purposes only. Always consult a licensed dermatologist or healthcare provider for medical concerns.

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 13 years of age to use our Platform. Users between 13-18 years must have parental or guardian consent.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials.

4. Payment Terms

4.1 Service Fee

Access to our comprehensive skin analysis and consultation service requires a one-time payment of ₹1,299 ('Rupees One Thousand Two Hundred Ninety-Nine Only') or as displayed on the Platform at the time of purchase.

4.2 Payment Processing

Payments are processed securely through our third-party payment gateway partners. By making a payment, you authorize us to charge the applicable fees to your selected payment method.

4.3 Taxes

All fees are inclusive of applicable taxes including Goods and Services Tax ('GST') as per Indian tax regulations.

5. User Responsibilities

You agree to:

• Provide accurate and honest information during consultations
• Upload clear, unaltered facial photographs as instructed
• Not misuse, reverse engineer, or attempt to extract our AI algorithms
• Not share your account credentials with third parties
• Not use the Platform for any unlawful or prohibited purpose
• Respect the intellectual property rights of Eternup

6. Intellectual Property Rights

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, images, software, and AI algorithms, are the exclusive property of Eternup and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.

7. Medical Disclaimers

By using our service, you acknowledge that you understand and accept these limitations. Eternup and its affiliates shall not be liable for any health consequences resulting from reliance on our AI-generated recommendations.

8. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We implement industry-standard security measures to protect your data, including facial images and health information. However, no system is completely secure, and we cannot guarantee absolute security.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETERNUP SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Health complications arising from following AI-generated recommendations
• Errors, inaccuracies, or omissions in the AI analysis
• Unauthorized access to or alteration of your transmissions or data

Our total liability shall not exceed the amount paid by you (₹1,299) for accessing the Platform.

10. Refund and Cancellation Policy

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of our services or AI systems
• Provision of false or misleading information

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
